Agent Access Addendum — Automated Clients and x402 Payments

This Addendum applies to access to the PinguProxy API (api.pinguproxy.com), including the /agent/v1 endpoints, by automated software clients, bots, scripts or AI agents ("Agent", and the operator responsible for it, "Operator", jointly "you"), and to payments made with the x402 payment protocol in USDC on the Base network.

By creating an order or settling any payment through the API, the Operator accepts these terms and the Terms on behalf of itself and of the Agent. Acceptance does not require a human signature, an account registration or an email address.

The Service offered through the API is the same as offered on the website: (a) prepaid PAYG credit in whole GB (from 5 to 200 GB); purchased credit does not expire and is served while the balance is above zero; and (b) 30-day passes for the datacenter plans (Basic, Pro, Enterprise), one proxy credential each, with no automatic renewal. All rules of the Terms apply, including the Acceptable Use Policy in full: you are responsible for the lawfulness of the traffic you route through the proxies. We may screen requests, refuse service and block wallets as provided by the Terms and by applicable law.

Prices are the website list prices in EUR, converted to USD at the European Central Bank reference rate plus a declared conversion buffer of 2%, rounded up to the cent. Each quote is valid for five (5) minutes and is bound to the quote identifier (X-Quote-Id); the amount actually charged is the one in the accepted quote. We may change prices, limits and available payment networks at any time.

Payments are made directly onchain through the x402 protocol in USDC on Base to the receiving address indicated by the API. Onchain payments are final: we do not issue onchain refunds.

An order is created only after the payment is settled and verified. If an order cannot be fulfilled, the corresponding value is automatically credited to the Agent's PAYG balance (GB at the PAYG list price) and can be used for further orders; once an order has been fulfilled and the credentials have been delivered, it is not refundable, and unused PAYG credit remains available indefinitely. Requests rejected with a 4xx response do not charge the payment. Refund requests from the Agent are accepted within seven (7) days; refunds are automatic PAYG credits and are never subject to manual review.

Open orders are limited to two (2) per agent/wallet, enforced automatically; free endpoints and order creation are rate limited. The agent API does not offer overage or any form of credit exposure: PAYG service stops at a zero balance. Limits may change as stated in section 4.

The API is provided "as is" and "as available". We aim for high availability but do not warrant uninterrupted service; scheduled or emergency maintenance may occur. The sections of the Terms on Service Availability and Limitation of Liability apply.

To provide the Service we process technical data of the Agent, including the wallet address used for payment, order and payment records and access logs (including IP address and request metadata), as described in the Privacy Policy. No personal data of the Operator is required to use the API.

We may block requests from restricted regions and screen payer addresses against applicable sanctions lists before settlement, and we may refuse or suspend the Service where required by law or by the Terms.

These terms are governed by the laws of Italy; disputes are resolved in Italy as provided by the Terms (amicable resolution first, and unresolved disputes through arbitration in Italy).
